Rapid Response, Heavy Haulage, General Towing And Recovery
These Terms And Conditions shall be governed by and construed in accordance with the laws of South Australia.
Rapid Response Towing, Heavy Haulage and Recovery services are available 24 hours a day, 7 days a week depending on current services being provided to other clients, Rapid Response may be delayed due to circumstances beyond our control.
Services are charged from depot to depot unless otherwise agreed in writing and charged with a minimum engagement of four (4) hours.
A deposit of 50% of the quoted amount may be required prior to dispatch and full payment is due immediately upon completion of the services unless otherwise agreed in writing.
After-hours, weekend and public holiday call-outs will attract additional charges at the applicable rates, these additional charges are subject to change without notice.
Where additional personnel are required to safely complete the work, those personnel will be charged at the applicable hourly rate from depot to depot and included in the final invoice and charged with a minimum engagement of four (4) hours.
Lonsdale Towing And Heavy Haulage reserves the right to retain possession of any vehicle, machinery or equipment until all outstanding invoices relating to that work have been paid in full.
The safety of our employees, customers and the general public is our highest priority. Traffic management is not included unless specifically requested and included in the quote. For works undertaken on public roads, high traffic areas, construction sites or locations where pedestrian or vehicle movements may be affected on Rapid Response work the client may be required to provide suitable traffic management before any work can commences.
Lonsdale Towing And Heavy Haulage reserves the right to suspend or cease work where traffic management, site conditions or other safety requirements are deemed inadequate.
Any delays caused by unsafe conditions or lack of traffic management may be chargeable at the applicable hourly rate.
Exclusion zones established by Lonsdale Towing And Heavy Haulage must be observed at all times.
Only authorised personnel employed or engaged by Lonsdale Towing And Heavy Haulage may enter designated work areas unless specifically directed by our personnel.
Should any person enter an exclusion zone without authorisation, work will cease immediately until the area is made safe.
Any delays resulting from breaches of exclusion zones may be charged to the client.
All equipment supplied by Lonsdale Towing And Heavy Haulage shall only be operated by authorised and competent personnel.
Customers, site personnel and members of the public are prohibited from operating company vehicles, trailers, winches, chains, load restraint equipment or any other equipment unless expressly authorised by Lonsdale Towing And Heavy Haulage.
Lonsdale Towing And Heavy Haulage shall not be liable for delays caused by:
- Traffic incidents
- Road closures
- Weather conditions
- Mechanical breakdowns
- Permit delays
- Government restrictions
- Site access issues
- Customer delays
- Events beyond our reasonable control
Additional waiting time may be charged where delays occur outside our control.
Where a booking is cancelled after equipment and personnel have been dispatched, a cancellation fee may apply.
Any permits, escorts, traffic management or third-party costs incurred prior to cancellation will remain payable by the client.
Lonsdale Towing And Heavy Haulage will exercise all reasonable care when handling vehicles, machinery and equipment.
Clients must disclose any known defects, operational issues, load restrictions or special handling requirements prior to transport.
The client remains responsible for ensuring safe and suitable access for loading and unloading operations. Any damage resulting from unsafe, unsuitable or undisclosed site conditions may be charged to the client.
Photos may be requested from the customer prior to accepting the quote.
Photos will be taken prior to loading of all Vehicles and machinery.
Lonsdale Towing And Heavy Haulage are not common carriers therefore insurance is not automatically provided, customers can either organise their own insurance or we can provide insurance at an additional cost which will be determined on a job by job basis. Insurance claims will only be assessed after full payment of quoted price with addition of any costs occurred during work. Any insurance claim must be submitted in writing within 7 days of completion of the work and will be assessed in accordance with the insurer’s terms and conditions.
Unless otherwise agreed in writing:
- Deposits are payable prior to commencement of work.
- Final payment is due upon completion of work.
- Overdue accounts may incur administration and debt recovery costs.
- Ownership of goods remains with the client at all times.
- Bank transfers or over the phone payments can be made via CommBank
Where permits, escorts, route surveys, pilot vehicles or other regulatory requirements are necessary, these costs will be charged in addition to transport charges unless otherwise stated.
Quoted schedules are subject to permit approvals and regulatory requirements.
Engaging Lonsdale Towing And Heavy Haulage to undertake any work constitutes acceptance of these Terms And Conditions.
Waiting time is charged at the same hourly rate quoted and will be added at the final bill it is the customers responsibility to ensure sites and access into sites is clean and ready for either loading or unloading.
Wet weather and Ground Conditions can be challenging and can create delays including but not limited to delays in loading or unloading and delays in travel. Unsafe ground conditions also include but are not limited to the following:
∞ Unsafe levels of ground unloading must be performed on level ground if machinery has to be unloaded on roads or areas that are not suitable the customer must arrange safe options prior to unloading waiting time will be charged if we have to wait for safe unloading. Lonsdale Towing And Heavy Haulage reserves the right to refuse loading or unloading where ground conditions are considered unsafe.
Load restraint will be performed by competent staff of Lonsdale Towing And Heavy Haulage only and will at all times be legal and compliant regardless of distance traveling or weight of loads, if the load restraint has be performed by a third party Lonsdale Towing And Heavy Haulage reserves the right to either check the restraint or add additional restraint if needed. Chain of responsibility lands on all parties involved in any vehicle or machinery movement and the team at Lonsdale Towing And Heavy Haulage take chain of responsibility seriously it is agreed that upon the acceptance of any work carried out that chain of responsibility is everyone’s concern.
All permit applications occur a fee of $300 this includes but is not limited to the application fee and time taken to submit and correspond with NHVR and SA Power Networks for Width Height and Weight Permits, permits can take up to 28 days to be received after the application has been submitted, Lonsdale Towing And Heavy Haulage takes no responsibility for incorrect measurements, dates given by the customer or roads planned not by us. If permits are required Lonsdale Towing And Heavy Haulage will not accept any other permits that are not in our name and we will stop work if permits are incorrect because of customers incorrect information, additional charges will be incurred if we have to stop work and wait for new permits. Any fines received for incorrect information will be added to the customers invoices if Lonsdale Towing And Heavy Haulage do not have the ability to check weights or measurements provided by the customer.
Unless otherwise stated, quotations are valid for 30 days from the date issued. Quotes are based on information supplied by the customer and may be revised if dimensions, weights, locations or site conditions differ from those provided.
Recovery work is inherently unpredictable. Quoted recovery prices are estimates only and additional charges may apply where unforeseen circumstances, additional equipment, labour, traffic management or environmental factors are encountered.
